In this work we examine critically how two competing approaches to meaning account for disagreements. We will argue that Hart's conventionalist stance does not commit him to descriptivism. That non-descriptivist theories of reference, properly understood, can account for a vast array of cases of interpretive disagreement and that and that an account of different kinds of disagreement can be provided from a conventionalist perspective within the framework of non-descriptivist theories of reference.

In this paper I analyse the problem of legal disagreements, initially raised by Ronald Dworkin against Hartian positivism. According to Dworkin, disagreements are pervasive, since law is an argumentative practice in which participants invoke normative arguments. Positivists, who claim that law depends upon agreement among officials, have difficulties to make sense of the fact that lawyers frequently disagree. I first present the main arguments in the debate. I then go on to distinguish different levels at which lawyers disagree. Taking these (...) levels into consideration, I articulate a pluralist reply that shows that the fundamental positivist tenets remain untouched by Dworkin’s challenge. (shrink)

El problema de los desacuerdos jurídicos puede ser planteado de diferentes modos. En una de sus versiones, el problema viene dado porque el positivismo asume que los conceptos jurídicos son criteriológicos, por lo que el desacuerdo entre juristas carece de sentido al ser una disputa meramente verbal. Plunkett y Sundell han ofrecido una respuesta novedosa a esta crítica que sostiene que no hace falta compartir un concepto para discrepar con sentido. We explore two ways of distinguishing the semantic operation of kind terms. First, we focus on a distinction between terms with a flexible versus terms with an inflexible semantics. Flexibility depends on whether some changes in the domain of application are taken to be possible while being consistent with past usage and what is intuitively the same meaning. On the other hand we discuss terms whose mode of operation is tolerant, in that the cohabitation in the speakers’ community of more (...) than one use or practice of use of the term in question is accepted. Those terms contrast with terms that operate in a strict way restricting severely the legitimacy of different uses that cut the domain of application in different ways. Among the latter we include terms with an ethical component and terms whose correct application involves high stakes. These distinctions are not new, since the phenomena that we identify as flexibility and tolerance have been observed, although in our view they have not been properly systematized and assessed. We argue that the two distinctions throw light on the bases of some disputes and on some legal disagreements. (shrink)

The concept of convention has been used in different fields and from different perspectives to account for important social phenomena, and the legal sphere is no exception. Rather, reflection on whether the legal phenomenon is based on a convention and, if so, what kind of convention is involved, has become a recurring issue in contemporary legal theory. In this book, some of the foremost specialists in the field make significant contributions to this debate. In the first part, the concept of (...) convention is analysed. The second part reflects on whether the rule of recognition postulated by Hart can be understood as a convention and discusses its potential and limitations in order to explain the institutional and normative character of law. Lastly, the third part critically examines the relations between conventionalism and legal interpretation. Given the content and quality of the contributions, the book is of interest to those wanting to understand the current state of the art in legal conventionalism as well as those wanting to deepen their knowledge about these questions. A partir de 1999 se estableció por la Oficina Regional de Educación para América Latina y el Caribe un programa de la red de liderazgo educativo para formar una masa crítica de profesionales de la educación, precursores en liderazgo transformacional. El artículo que se presenta tiene entre sus propósitos valorar las tendencias contemporáneas de la superación en liderazgo docente en Latinoamérica, así como de los principales (...) modelos y teorías donde se incluye además, una estimación de los diversos estilos de liderazgo y su importancia para el logro de un rol transformador en el docente de la educación superior. Quality higher education institutions have the characteristic to develop a pedagogy of change. Since 1999, the Education Regional Office for Latin America and the Caribbean established a program of the educative leadership net, in order to create a critical group of professionals of the educative system, pioneers in transformational leadership. One of the main purposes of the following article is to assess contemporary trends of the bettering processes in teaching leadership in Latin America, as well as, the main models and theories. Las naciones y pueblos indígenas presentan preocupantes índices respecto a la salud, así como otras carencias como la pérdida de sus tierras, la alimentación, la educación y, en general, el ejercicio de sus derechos, consagrados por organizaciones internacionales como la ONU y la OMS-OPS. An individual's health, genetic, or environmental-exposure data, placed in an online repository, creates a valuable shared resource that can accelerate biomedical research and even open opportunities for crowd-sourcing discoveries by members of the public. But these data become “immortalized” in ways that may create lasting risk as well as benefit. Once shared on the Internet, the data are difficult or impossible to redact, and identities may be revealed by a process called data linkage, in which online data sets are matched (...) to each other. Reidentification, the process of associating an individual's name with data that were considered deidentified, poses risks such as insurance or employment discrimination, social stigma, and breach of the promises often made in informed-consent documents. At the same time, re-ID poses risks to researchers and indeed to the future of science, should re-ID end up undermining the trust and participation of potential research participants. The ethical challenges of online data sharing are heightened as so-called big data becomes an increasingly important research tool and driver of new research structures. Big data is shifting research to include large numbers of researchers and institutions as well as large numbers of participants providing diverse types of data, so the participants’ consent relationship is no longer with a person or even a research institution. In addition, consent is further transformed because big data analysis often begins with descriptive inquiry and generation of a hypothesis, and the research questions cannot be clearly defined at the outset and may be unforeseeable over the long term. In this article, we consider how expanded data sharing poses new challenges, illustrated by genomics and the transition to new models of consent. We draw on the experiences of participants in an open data platform—the Personal Genome Project—to allow study participants to contribute their voices to inform ethical consent practices and protocol reviews for big-data research. Diversas investigaciones confirman que la evaluación de la información estadística constituye una limitante para el profesional de la Medicina. Incluso en ocasiones se tiende a posturas éticas y bioéticas inadecuadas que generan problemas para las ciencias médicas; y por ende, para la sociedad. Por esa razón, el objetivo del artículo consistió en fundamentar teóricamente la competencia evaluar información estadística para el profesional de la Medicina. Los resultados obtenidos evidencian la necesidad de concebir el proceso de evaluación de la información estadística (...) como una competencia para dicho profesional. Various investigations confirm that the evaluation of statistical information constitutes a limitation for health professionals. There are potentially inappropriate ethical and bioethical positions garnered from data with limited evaluation that can generate problems for the medical science fields and potentially, for society as a whole. For that reason, the objective of this article was to theoretically support the health professional's skill to evaluate statistical information. The results obtained suggest the need to develop a competency process for health professionals in the evaluation of statistical information. (shrink)

The “systematicity argument” has been used to argue for a classical cognitive architecture (Fodor in The Language of Thought. Harvester Press, London, 1975, Why there still has to be a language of thought? In Psychosemantics, appendix. MIT Press, Cambridge, pp 135–154, 1987; Fodor and Pylyshyn in Cognition 28:3–71, 1988; Aizawa in The systematicity arguments. Kluwer Academic Press, Dordrecht, 2003). From the premises that cognition is systematic and that the best/only explanation of systematicity is compositional structure, it concludes that cognition is (...) to be explained in terms of symbols (in a language of thought) and formal rules. The debate, with connectionism, has mostly centered on the second premise-whether an explanation of systematicity requires compositional structure, which neural networks do not to exhibit (for example, Hadley and Hayward, in Minds and Machines, 7:1–37). In this paper, I will take issue with the first premise. Several arguments will be deployed that show that cognition is not systematic in general; that, in fact, systematicity seems to be related to language. I will argue that it is just verbal minds that are systematic, and they are so because of the structuring role of language in cognition. A dual-process theory of cognition will be defended as the best explanation of the facts. (shrink)

Our purpose in this essay is to introduce new concepts in a wide and recursive view of the systemic consequences of the following biological facts that I and we have presented that can be resumed as: that as living systems we human beings are molecular autopoietic system; that living systems live only as long as they find themselves in a medium that provides them with all the conditions that make the realization of their living possible, that is, in the continuous (...) conservation of their relation of adaptation to the circumstances in which they find themselves; that as a living system exists only in a relation of adaptation with the medium that operates as its ecological niche, its reproduction necessarily occurs as a process of systemic duplication or multiplication of the ecological organism-niche unity that it integrates; that the worlds of doings that we generate as languaging beings in our conversations, explanations, reflections and theories are part of our ecological niche; and that we human beings as living beings that exist in languaging, are biological–cultural beings in which our cultural and our biological manners of existences can be distinguished but cannot be separated. Of the systemic consequences of these biological facts that we consider in this essay, we wish to mention two as the principal: that the diversification of manners of living produced in biological evolution is the result of differential survival in a changing medium through the conservation of adaptation, and not through competitive survival of the best; and that we in our living as languaging human beings are the epistemological fundament of all that we do and know as such. El artículo problematiza el abordaje de la ética en la investigación en psicología con infancias en el siglo XX y su articulación con los códigos y principios éticos. Se elaboran tres puntos de inflexión con la literatura en la materia, a saber: (1) un cuestionamiento en la producción de universales que ponen siempre la exclusión de un singular susceptible de ser sometido a suplicio, (2) desplazamiento de la idea de que existe una buena y una mala lectura de los documentos (...) prescriptivos para instalar un énfasis en la multiplicidad de lecturas y usos que se desprenden de los marcos legales, normativos, deontológicos y heurísticos; y (3) una observación de la figura del investigador realzando su carácter marcado en una posición dentro de dinámicas socio-histórico-materiales. Son abordados dos casos de experimentación con infancias en psicología, correspondientes al caso del Pequeño Albert por John B. Watson y Raslie Rayner en 1920, y el protocolo experimental de la Situación Extraña realizado en la década de 1970 por Mary Ainsworth y que fue la base de la Teoría del Apego inventada por John Bowlby. Se concluyen una serie de desafíos para la formación en ética de la investigación en psicología que exceden los márgenes de un enfoque centrado en el conocimiento y manejo de marcos legales, normativos, deontológicos y heurísticos para la resolución de dilemas éticos. La disminución de dopamina en los ganglios basales es la principal causa de la enfermedad de Parkinson. Además de las disfunciones motrices, los individuos con EP presentan alteraciones cognitivas que incluyen déficits de control atencional y temporal, de percepción del ritmo de la música y del habla, y de procesamiento del lenguaje. El circuito estriado-tálamo-cortical, participa en la comprensión musical y del habla. Personas con EP presentan problemas en distinguir las estructuras rítmicas por verse afectado el funcionamiento de los GB (...) y, por lo tanto, el control de su pulso interno en el CETC. Sin embargo, se ha encontrado que personas con EP pueden mejorar su sincronización temporal interna mediante el acompañamiento de señales auditivas externas temporalmente predecibles. Estudios argumentan que señales de este tipo pueden compensar la vía disfuncional CETC mediante una interface con el circuito cerebelo-tálamo-cortical el cual es sensible a la codificación de eventos temporales. En este artículo se formula un análisis crítico sobre el uso de Rúbricas durante los ejercicios de coevaluación entre pares sobre su desempeño en la investigación desarrollada en los estudios de posgrado. Las entrevistas a estudiantes y docentes muestran cómo se profundiza y amplía la comprensión de la descripción académica sobre el resultado que se busca por la aplicación de la metodología, debido a la observación contrastada del trabajo propio con el desempeño de los demás, de acuerdo con el sistema (...) de la enseñanza de la metodología de investigación propuesta por Alcántara y Ramírez (2022). Estos apuntes gozan de significativa importancia ya que, vistos desde una amplia perspectiva, muestran la preocupación del joven filósofo por clarificar a partir de esa temprana época el horizonte conceptual del cual parte; a su vez, desde un punto de vista más específico, nos permiten rastrear algunos de los elementos iniciales que motivarán la (...) posterior crítica radical a la filosofía schopenhaueriana. The recruitment of respondents belonging to ethnic minorities poses important challenges in social and health research. This paper reflects on the enablers and barriers to recruitment that we encountered in our research work with persons belonging to ethnic minorities. Additionally, we applied the Matching Model of Recruitment, a theoretical framework concerning minority recruitment, to guide our reflection. We also explored its applicability as a research design tool. In assessing our research experience, we learned that minority recruitment in social and health (...) research is influenced by the social context of all key players involved in the research. Also, there are enablers and barriers within that social context facilitating or delaying the recruitment process. The main enablers to recruit respondents belonging to ethnic minorities include working with community agencies and gatekeepers who share a common vision with researchers and the latter’s ability to gain the trust of potential respondents. The main barriers include demanding too much from these same community agencies and gatekeepers and ignoring factors that could delay the completion of the research. Although we found the Matching Model of Recruitment to be an effective tool in assessing the processes of recruiting respondents belonging to ethnic minorities, further empirical research is needed to explore its usefulness during the research planning phase. This paper explores the filmic trajectories experienced by the protagonists in two case studies: Lightning Over Water by Nicholas Ray and Wim Wenders, and Sick, The Life and Death of Bob Flanagan, Supermasochist by Kirby Dick. In both films, the limitexperience, caused by a disease, becomes an active device, one that produces knowledge for the protagonists. In this radical experience, what is revealed is the link between selfrepresentation and a will to self-destruction, and the normative margins of rationality are questioned. (...) Based on the studies of Jean-Luc Nancy, Jean Baudrillard and Clément Rosset, this essay examines an approach to terminal illness and self-representation both in the context of pain and the voyeuristic process of death as a spectacle. With the arrival of the nineteenth century, a process of change guided the treatment of three basic elements in the development of mathematics: rigour, the arithmetization and the clarification of the concept of function, categorised as the most important tool in the development of the mathematical analysis. In this paper we will show how several prominent mathematicians contributed greatly to the development of these basic elements that allowed the solid underpinning of mathematics and the consideration of mathematics as an axiomatic (...) way of thinking in which anyone can deduce valid conclusions from certain types of premises. This nineteenth century stage shares, possibly with the Heroic Age of Ancient Greece, the most revolutionary period in all history of mathematics. (shrink)

Desde mediados del siglo XX, el devenir de la salvaguarda relacionada con las viviendas ha avanzado desde la monumentalidad hasta el contexto, desde la individualización hasta la caracterización paisajística, desde las condiciones materiales hasta los aspectos vivenciales. Sin embargo, amparar el cuerpo de las residencias típicas de cada territorio, en especial en los dinámicos marcos urbanos, resultó —y resulta— un desafío. Las experimentaciones de propuestas hacia un amparo residencial a más largo plazo han coincidido en dos aspectos de interés: la (...) promoción de indicadores de sustentabilidad patrimonial, inscriptos en cada marco estatal-local preservacionista, junto con el reconocimiento y el tratamiento del rol usuario. En este sentido, desde variables histórico-arquitectónicas y sociales se propuso la construcción y la aplicación de indicadores de sustentabilidad patrimonial residencial para visibilizar problemas y potencialidades hacia una formulación de estrategias de preservación apropiadas. Para ello se abordó la ciudad de Mar del Plata, una aglomeración intermedia bonaerense paradigmática debido a sus dinamismos pasados y presentes, con foco en sus chalets “estilo Mar del Plata” y sus usuarios. Se analizaron dos barrios históricos —Stella Maris y La Perla—, donde sobrevive una relevante diversidad de chalets en un marco de múltiples riesgos que afectan su permanencia. Desde una perspectiva principalmente cualitativa, apoyada por datos cuantitativos, se articularon relevamientos in situ, fuentes escritas (investigaciones previas, artículos científicos, cartas patrimoniales), gráficas (planimetrías, fotografías, imágenes aéreas) y orales (encuestas, entrevistas). De esta manera, la indagación desarrollada permitió avanzar en renovados caminos para progresar en la salvaguarda del legado residencial contextual. (shrink)

En el marco de la Universidad Nacional de Córdoba movilizada por los acontecimientos sociales y políticos, surgió Libre Teatro Libre (LTL), que fue luego uno de los grupos de teatro militante más reconocidos de la época. Realizaré un recorrido crítico por el proceso político en torno al Cordobazo a través del análisis de la experiencia de LTL, poniendo de relieve aspectos significativos que operan (...) como metonimia (por asociación o por contraste) de otras experiencias, para reflexionar en torno a problemáticas como las conexiones entre militancia y experimentación; las apuestas estéticas en función de los objetivos artístico-políticos; entre otras. Background The prioritization protocols for accessing adult critical care in the extreme pandemic context contain tiebreaker criteria to facilitate decision-making in the allocation of resources between patients with a similar survival prognosis. Besides being controversial, little is known about the public acceptability of these tiebreakers. In order to better understand the public opinion, Quebec and Ontario’s protocols were presented to the public in a democratic deliberation during the summer of 2022. Objectives (1) To explore the perspectives of Quebec and Ontario (...) citizens regarding tiebreakers, identifying the most acceptable ones and their underlying values. (2) To analyze these results considering other public consultations held during the pandemic on these criteria. Methods This was an exploratory qualitative study. The design involved an online democratic deliberation that took place over two days, simultaneously in Quebec and Ontario. Public participants were selected from a community sample which excluded healthcare workers. Participants were first presented the essential components of prioritization protocols and their related issues (training session day 1). They subsequently deliberated on the acceptability of these criteria (deliberation session day 2). The deliberation was then subject to thematic analysis. Results A total of 47 participants from the provinces of Quebec (n = 20) and Ontario (n = 27) took part in the online deliberation. A diverse audience participated excluding members of the healthcare workforce. Four themes were identified: (1) Priority to young patients - the life cycle - a preferred tiebreaker; (2) Randomization - a tiebreaker of last resort; (3) Multiplier effect of most exposed healthcare workers - a median acceptability tiebreaker, and (4) Social value – a less acceptable tiebreaker. Conclusion Life cycle was the preferred tiebreaker as this criterion respects intergenerational equity, which was considered relevant when allocating scarce resources to adult patients in a context of extreme pandemic. Priority to young patients is in line with other consultations conducted around the world. Additional studies are needed to further investigate the public acceptability of tiebreaker criteria. In this text, I consider two examples in the history of emancipation and manumission of enslaved, Black populations in the Caribbean and South America in order to theorize a colonial mode of conceiving of freedom at play in the first half of the nineteenth century. This mode is marked by the figure of the promise, enacting a notion of freedom as a constantly deferred, external compensation. Indeed, instead of an immediate decision deeming the practice of enslavement and trade of human (...) beings unacceptable, and an effective liberation of the enslaved Black populations in these different emancipation proclamations, the various histories of manumission in Latin America and the Caribbean show a long series of political and legal attempts to reduce and limit the extent of the slave trade that deferred the process of liberation for decades. Moreover, in many of these territories the practice did not end with the official proclamation of emancipation but was continued by illegal practices and mutations into legal forms of exploitation and oppression that are still operative today. After outlining this first trajectory, reconstructing the promise of manumission in the historical examples of Martinique (as read by Édouard Glissant) and La Gran Colombia and the Republic of Nueva Granada (contemporary Panamá, Colombia, Venezuela, and Ecuador), I analyze a second mode of investigation in examples of individual and collective strategies of liberation coming from the enslaved themselves, as reconstructed by contemporary feminist scholars in South America. These strategies appropriate liberation not as a promise, but as a negotiation and calculation that begins with the enslaved’s resistance to their oppressive conditions and that ultimately depends on the external concession by juridical authorities. In the third section of the chapter, I read these practices not as marronage, as they are sometimes approached, but as a different mode of turning back to these glimpses of freedom that more effectively challenge the narrative of emancipation and, with it, the promise of manumission in our present. -/- . Ordinary use of empty names encompasses a variety of different phenomena, including issues in semantics, mental content, fiction, pretense, and linguistic practice. In this paper I offer a novel account of empty names, the cognitive theory, and show how it offers a satisfactory account of the phenomena. The virtues of this theory are based on its strength and parsimony. It allows for a fully homogeneous semantic treatment of names coped with ontological frugality and empirical and psychological adequacy.

Grâce à l’analyse de quatre autobiographies de femmes de ménage écrites entre 1975 et 2012, cet article interroge la manière dont le régime temporel propre à une activité professionnelle contribue à la définition de la structure du récit autobiographique. Il s’agit d’analyser les nouvelles rhétoriques développées pour raconter l’histoire d’une vie dans laquelle l’axe de la narration est ancré sur un rôle social particulier et se définit par une activité spécifique : faire le ménage chez les autres.Le choix du corpus (...) d’analyse nous permet de mettre en perspective diverses expériences de femmes de ménage. On s’appuiera ainsi sur les autobiographies de Maria Arondo et Fatima Elayoubi, ayant respectivement migré en France depuis l’Espagne et le Maroc. Mais aussi sur les récits de Louise Rafkin et Isaure qui, dotées d’une formation en lettres, décident d’entreprendre l’aventure de devenir femme de ménage pour la raconter. Malgré leurs différences, ces expériences singulières ont des points communs et soulignent, chacune à leur manière, la particularité de cette relation de travail. (shrink)

The importance of mathematics in the context of the scientific and technological development of humanity is determined by the possibility of creating mathematical models of the objects studied under the different branches of Science and Technology. The arithmetisation process that took place during the nineteenth century consisted of the quest to discover a new mathematical reality in which the validity of logic would stand as something essential and central. Nevertheless, in contrast to this process, the development of mathematical analysis within (...) a framework that largely involves intuition and geometry is a fact that cannot go unnoticed amongst the mathematics community, as we shall show in this paper through the research made by Bernhard Riemann on complex variables. The green economy redefines the function of economics as the study and management of sustainability for solving economic crisis. This article suggests the existence of economic paradigms, arguing they have no solution. They are the same ones of complexity; in other words, around all living beings who study the system, within the various biological levels: in the bioeconomy. The study of these paradigms is based on the contemporary scientific method conditioned to classical logic. «Palabra de Dios» no se dice sólo con referencia a las Sagradas Escrituras; Jesucristo es la Palabra de Dios por antonomasia frente a la cual las demás expresiones de Palabra de Dios, incluyendo la Biblia, lo serán en sentido análogo y dependiente. Esto significa que tras la hermenéutica bíblica cristiana subyace la fe cristológica, de tal modo que lo que se predica de la naturaleza de la Sagrada Escritura, Palabra de Dios puesta por escrito, sea consecuencia directa de lo que (...) se predica de Jesucristo, Palabra de Dios encarnada. Ello, además de incidir en la vida y la fe del creyente, tiene importantes implicaciones epistemológicas, metodológicas y práxicas para la hermenéutica bíblica hoy. «Word of God» doesn’t onlj refer to the Holj Scaptures; Jesús Christ is the Word of God par excellence against which all other expressions of God’s Word, including the Bible, are anahgous and dependent. This means that behind Christian biblical hermeneutics lies faith in Christ, so that what is preached on the nature of the Holj Scripture, the written Word of God, is directlj dependent on what is preached about Jesús Christ, the Word of God incarnate. This, besides influencing the ufe and faith of the beüever, has important epistemological, methodological and practical consequences for current biblical hermeneutics. (shrink)

En 1919, la même année où Jean Giraudoux fait son « Adieu à la guerre », il écrit « Les morts d’Elpénor ». En 1926, à côté de trois autres histoires, ce texte intégrera le corps d’Elpénor, déterminant l’ensemble, une collection de quatre textes écrits pendant dix-huit ans, le premier étant « Cyclope », écrit en 1908 ; le deuxième, « Sirènes », en 1912 ; le troisième en 1919 ; et le dernier en 1926, « Les nouvelles morts d’Elpénor (...) ». Quand « Cyclope » et « Sirènes » sortent respectivement chez Le Matin en 1908 et chez Paris-Journal en 1912 aucun d’entre eux ne mentionne Elpénor. Bref, c’est avec le développement des deux dernières histoires, que Elpénor, cette figure effacée chez Homère et absente dans les deux premiers textes de Giraudoux, vole la vedette. Cet article voudrait montrer comment la mise à jour du héros et de ses histoires est en dialogue avec la guerre vécue par l’auteur, pour proposer comment les vieilles histoires, lorsqu’elles sont renouvelées, participent à un processus qui leur permet d’élaborer les défis du présent, communiquant le présent, à travers un code déjà public, l’Odyssée. Las directrices anticipadas aún no se encuentran legisladas en todos los estados de la República mexicana. En algunos de los estados en los que sí se encuentran legisladas, se prohíbe expresamente su validez durante el periodo de gestación. Lo anterior representa dilemas bioéticos y jurídicos importantes, los cuales revisamos para esclarecer las diversas interrogantes que surgen en materia de la protección tanto del bebé como de la madre gestante. Concluimos que existe una necesidad de desarrollar una ley federal que homologue (...) las directrices anticipadas, garantizando una muerte digna a todos los mexicanos, y que establezca que en caso de encontrarse en periodo de gestación, se busque asesoría por un comité de bioética que apoye a determinar en cada caso particular, las condiciones que favorezcan el desarrollo y supervivencia del bebé, siempre que sea posible, sin recurrir a tratamientos y/o medidas extraordinarias que pongan el riesgo la muerte digna y libre de sufrimiento de la madre. The question around foreigners and their obligation to respect and fulfil the national - or civil - norms of the territory where they are; has become due the migration and multicultural movements once again a key one. Addressed by a multitude of authors along the centuries, the question has been answered based on the different placements around juridical and political concepts like citizenship, sovereignty, authority or law. In this investigation, the doctrinal development carried out around the obligatory nature of the (...) civil norm for foreigners in Spanish scholasticism is going to be considered. Specifically, due to its thoroughness and depth, the doctrine done by Francisco Suarez is going to be critically analysed. Once the answer given in our author's doctrine to the question posed has been established, we will consider the possible influences in the Anglo-Saxon sphere. (shrink)

Tradicionalmente la conceptualización del tópico persona se ha circunscrito a ámbitos como la teología, la filosofía o la antropología. Sin embargo, la incorporación del tópico a gran parte de los textos de naturaleza política, así como en las declaraciones de derechos y tratados internacionales adoptados a partir de la II Guerra Mundial ha supuesto la constitucionalización del mismo. Consecuentemente, como término constitucional su interpretación queda a merced de los actores jurídicos designados para ello en el sistema político constitucional. Es por (...) ello, que, con el fin de determinar el contenido de significado actual del tópico ha de atenderse a las sentencias que interpretan la norma fundante. En este artículo, centramos nuestro estudio en la jurisprudencia del Tribunal Constitucional Español. Esto nos permite poner de relieve el concepto de persona en ellas contenido: su alcance y sus limitaciones. (shrink)
